Viral Sonnet is an AI-powered platform designed to help users generate engaging, trend-aware social media content, primarily for Twitter. The Service includes various features such as tweet generation, personalized brand voice customization, trend analysis, and engagement predictions.

You must be at least 18 years old to use our Service. By agreeing to these Terms, you represent and warrant that:

Subscription fees are charged in advance on a monthly or annual basis, depending on the plan selected. By subscribing to a paid plan, you authorize us to charge your chosen payment method on a recurring basis until your subscription is canceled.

You may cancel your subscription at any time through your account settings, but no refunds will be provided for any unused portion of the current billing period unless required by law.

7. User Content

Our Service allows you to input, generate, and share various forms of content, including text, images, and data ("User Content"). You retain all of your ownership rights in your User Content.

By submitting User Content to the Service, you grant Viral Sonnet a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your User Content in any existing or future media, for the purpose of providing, improving, and promoting the Service.

You represent and warrant that:

  • You own or have the necessary rights to use and authorize us to use your User Content.
  • Your User Content does not violate any third party's intellectual property rights, privacy rights, publicity rights, or other personal or proprietary rights.
  • Your User Content does not violate any applicable law or regulation.

8. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

  • Using the Service for any illegal purpose or in violation of any local, state, national, or international law.
  • Violating or infringing on the rights of others, including intellectual property rights.
  • Generating or distributing content that is unlawful, defamatory, harassing, abusive, fraudulent, or otherwise objectionable.
  • Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Service.
  • Scraping, data mining, or otherwise collecting information from the Service without our express written consent.
  • Using the Service in any manner that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying the Service.
  • Uploading or transmitting viruses, malware, or other types of malicious software.
  • Impersonating or misrepresenting your affiliation with any person or entity.
  • Encouraging or enabling any other individual to do any of the foregoing.

9. Intellectual Property Rights

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Viral Sonnet and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Viral Sonnet.

While you retain ownership of your User Content, the outputs generated by our AI system through the Service are licensed to you for your use but are ultimately derived from our proprietary technology and systems.

10. DMCA Compliance

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on the Service, please notify our copyright agent as set forth in the Digital Millennium Copyright Act of 1998 (DMCA). For your complaint to be valid under the DMCA, you must provide the following information in writing:

  1. An electronic or physical signature of a person authorized to act on behalf of the copyright owner.
  2. Identification of the copyrighted work that you claim is being infringed.
  3. Identification of the material that is claimed to be infringing and where it is located on the Service.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. VIRAL SONNET EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

VIRAL SONNET MAKES NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS, OR THAT DEFECTS WILL BE CORRECTED.

VIRAL SONNET MAKES NO WARRANTIES REGARDING THE QUALITY, ACCURACY, TIMELINESS, TRUTHFULNESS, COMPLETENESS, OR RELIABILITY OF ANY CONTENT GENERATED THROUGH THE SERVICE.

12. Limitation of Liability

IN NO EVENT WILL VIRAL SONNET, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

VIRAL SONNET'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE IS LIMITED TO THE AMOUNTS YOU HAVE PAID TO VIRAL SONNET FOR ACCESS TO AND USE OF THE SERVICE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE DATE ON WHICH THE APPLICABLE CLAIM AROSE.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

13. Indemnification

You agree to defend, indemnify, and hold harmless Viral Sonnet, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, your User Content, any use of the Service's content, services, and products other than as expressly authorized in these Terms.

14. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service or request account deletion through the account settings.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

15. Governing Law
